Landmark Sues EPA for Violating Federal Law

(Herndon, Virginia) ... Landmark Legal Foundation (Landmark) sued the Environmental Protection Agency (EPA) today for violations of the Freedom of Information Act (FOIA). Landmark seeks from the EPA all information disclosing any contacts and discussions EPA officials have had with outside special interests in preparing soon to be released environmental regulations. Despite legal requirements compelling the EPA to release this information, it refuses to do so. Landmark filed suit in federal district court.


Landmark believes the EPA and liberal groups are rushing to issue last-minute regulations prior to the end of the current administration. An August 25, 2000 Washington Post story reveals that:


Mindful that Republicans could occupy the White House in less than six months, the Clinton administration is working feverishly to issue a host of new regulations supported by environmentalists and other liberal-leaning groups but opposed by many business and industry organizations.


The proposed rules would set tougher standards on a variety of topics from food labeling and diesel exhaust to the regulation of federal contractors. Taken as a group, they could account for a major chapter in Bill Clinton's presidency.


Landmark also intends to ask the Court to block the EPA from issuing any new regulations until the EPA releases the information Landmark seeks, as required by law.
