Landmark Asks Supreme Court to Strike Down Obamacare -- Again.

Landmark Legal Foundation filed a friend of court brief in the U.S. Supreme Court urging the justices to uphold a federal appeals court decision striking down Obamacare. Now that Congress has eliminated the individual mandate there is nothing left of the original Supreme Court decision upholding Obamacare's constitutionality.

You may recall that Chief Justice Roberts stunned conservatives, not to mention his colleagues on the court, by concluding that the individual mandate was a tax, which rendered Obamacare a constitutional statutory scheme. Landmark was the only organization (out of dozens filing amicus briefs in the case) that saw the tax question coming and briefed the issue. We demonstrated that the individual mandate was an unconstitutionally structured tax. We renewed our argument in California v. Texas.
